FEBRUARY 13--The Texas Parks and Wildlife Department today issued a report on Vice President Dick Cheney's accidental shooting Saturday of a fellow quail hunter on a sprawling Texas ranch. The hunting accident report, a copy of which you can find below, briefly recounts how Cheney plugged Harry Whittington, a 78-year-old Austin lawyer, with birdshot in the face, neck + chest. According to the state report, Cheney was wearing a "blaze orange" cap and "coat/vest" and brown trousers and was toting an Italian-made Perazzi 28-gauge shotgun. In addition to the document's release, wildlife officials reported today that while Cheney had purchased a valid non-resident hunting license, he did not obtain a required "upland game bird stamp." As a result, a warning citation--which carries no fine or penalty--will be issued to Cheney, which state officials described as "routine." And as for whether Cheney would have needed to previously take a hunters education course, state wildlife officials noted that such classes are only required of hunters born on or after 02.Sep.1971 .

While yet to release its report on the shooting, the Kenedy County Sheriff's Office this afternoon issued a press release noting that an "investigation reveals that there was no alcohol, or misconduct involved in the incident." Big questions, like why were wounds that were reported by Ms. Armstrong to be so superficial keeping the victim in the ICU for 48 hours?

Was the shot fired from 30 yards or 30 feet;

both have been reported?

Why did it take almost three hours to get this poor guy admitted to the hospital after said incident, even with a medical crew at the scene?

When were authorities notified, as per TX law?

Why was the press not informed for 22 hours?

And was the sheriff allowed to interview Cheney or not; the reports are conflicting (though not really)?
Though the sheriff's office issued a statement that ruled out alcohol, there is no indication that any real tests were taken to verify this.

All manner of hunters have weighed in on these details + the consensus is pretty clear:

the only way this sort of thing does happen - and it does - is if the shooter is dumb or drunk or both.

The Dickie Fudd story is veritably exploding out there. The press corps is on fire, the blogosphere is practically vaporizing + there are now so many angles exposed, it's hard to keep up.
First of all, an alert commenter hooked us up with some background on Whittington's role in the funeralgate scandal during Georgie's last days as TX guv, one in which his Chief of Staff Allbaugh played a key role

(+ then went on to head FEMA, turn it over to Brownie so he could go lobby, ending up in NOLA to milk that tragedy for all it was worth while his protege floundered in fashion).

Evidently a lot of covering up of a lot of stuff was going on + a whistleblower who was fired,

then filed suit (and then evidently settled for a paltry $50,000?), has seemingly vanished from view.

That settlement datum is the most recent info I could find on that story, now I can't relocate it + Robert Bryce appears to have moved on from the whole shebang. Anyone have more?

"Das ist ein enormer Eisverlust", erklärte Thompson. "Es gab keine Bildung von neuem Eis an den Gletschern seit dem Jahr 2000."
Mit Hilfe von Luftaufnahmen will der Geoforscher den Schwund des Eisvolumens genauer berechnen. Er befürchtet dramatische Folgen für die Bewohner der Region. Zum einen ist das Tourismusgeschäft bedroht. Zum anderen könnte auch eine wichtige Wasserquelle versiegen.
Thompson will jetzt mit einer Isotopenanalyse herausfinden, wie hoch der Anteil des Schmelzwassers am gesamten Verbrauch der Menschen in der Nähe des Kilimandscharos ist. Noch will er nicht ausschließen, dass das genutzte Wasser überwiegend aus den Regenwäldern des Berges stammt.

Bei Experimenten mit Ratten haben die Wissenschaftler herausgefunden, dass beim normalen Atmen eine ganze Reihe von Nervenzellen aktiv ist, die meisten davon aber ihre Arbeit unter Sauerstoffmangel einstellen. Die übrigen Zellen reagieren demnach auf den niedrigen Sauerstoffgehalt, indem sie einen winzigen Kanal in ihrer Membran öffnen, durch den Natrium-Ionen in die Zelle hineinströmen. Dieser Natriumstrom veranlasse dann die fürs Atmen zuständigen Muskeln, sich ruckartig zusammenzuziehen, so dass schnell eine große Menge Sauerstoff in die Lungen transportiert werde.

Fast vier Jahrzehnte saß der Inder Jagjivqan Ram Yadav in Haft, ohne dass ihm jemals der Prozess gemacht worden wäre. Der simple Grund: Die Behörden hatte seine Akte verloren und ihn einfach im Gefängnis gelassen. Jetzt wurde der inzwischen 70-Jährige freigelassen.

Milkipur - 1968 war der Inder unter dem Verdacht verhaftet worden, seine Schwägerin getötet zu haben. Heute ordnete das höchste indische Gericht in Neu-Delhi die Freilassung Yadavs auf Kaution an.
Der Fall des alten Mannes gilt als ein extremes Beispiel für das chaotische indische Justizsystem, in dem Arme und Unterprivilegierte schutzlos sind und oft einfach "vergessen" werden. So hatte Yadavs Familie 38 Jahre in dem Glauben gelebt, er sei verstorben.
Erst im Juli war sein Fall von Zeitungen entdeckt worden, als die Gefängnisbehörde bei Gericht nach einem Verhandlungstermin für Yadav nachfragte. Schließlich hatte sich eine Gruppe von Anwälten für die Freilassung des Langzeit-Häftlings eingesetzt. Er wird nun von seiner Frau in seinem Heimatdort Milkipur erwartet.

Das stört Larry Silverstein nicht. Er ist nämlich damit beschäftigt, aus dreieinhalb Milliarden Dollar das Doppelte zu machen. Eigentlich müßte Larry Silverstein ein am Boden zerstörter Mann sein. Der 11. September 2001 ebnete nicht nur sein 47-stöckiges Gebäude WTC 7 ein, sondern machte auch noch die beiden 110 Stockwerke hohen Zwillingstürme des World Trade Centers dem Erdboden gleich. Diese hatte er am 26. Juli 2001 gerade für die nächsten 99 Jahre gepachtet.
48 Tage später sitzt Larry Silverstein auf einem Haufen Schutt - der ihm nun Milliardenprofite einbringen wird. Zusammen mit seinem australisch-israelischen Partner Frank Lowy konnte sich Silverstein die Pacht der Zwillingstürme zu einem äußerst vorteilhaften Preis sichern. Dabei half ihm seine langjährige Freundschaft zu Lewis Eisenberg, der den Deal ausgehandelt hatte. Eisenberg war nämlich Vorsitzender der Hafenbehörde von New York und New Jersey gewesen, jener staatlichen Institution, der das World Trade Center gehörte.
Silverstein und Eisenberg kennen sich von jener Zeit, als beide leitende Funktionen bei United Jewish Appeal hatten, einer jüdischen Wohltätigkeitsorganisation, die laut dem Journalisten Christopher Bollyn Milliarden umsetzt. Lewis Eisenberg war zudem Vizepräsident des stärksten Armes der Israellobby, dem American Israel Public Affairs Committee (siehe ZS 36, Seite 54). Heute ist Eisenberg der wichtigste Spendeneintreiber für die Republikanische Partei von Präsident Bush. Immobilientycoon Larry Silverstein wird nun bald im Geld schwimmen, weil das von ihm gepachtete Grundstück des World Trade Centers für 3.55 Milliarden Dollar versichert war. Das ist Silverstein jedoch nicht genug. Seine Anwälte argumentieren, daß der 11. September im Grunde genommen zwei Versicherungsfälle darstelle, weil ja auch zwei Flugzeuge in die Türme eingeschlagen hätten. Also müsse auch die doppelte Versicherungssumme ausbezahlt werden. Harold Rubenstein, der Sprecher von Silversteins Immobilienkonzern, ist zuversichtlich, daß man vor Gericht gewinnen werde.
Einen Wehrmuts-Tropfen gibt es allerdings: Am 14. Januar 2002 hatte eine Gläubigerfirma von Silverstein beim State Supreme Court in Manhattan eine Klage gegen ihn eingereicht. Der Grund: Er habe die für den 11. September bereits ausbezahlten Versicherungsgelder zum Teil illegal verwendet. Konkret wirft man Silverstein vor, er habe mit dem Geld Lobbyisten in Albany und Washington bezahlt und damit versucht, seine Haftung gegenüber den Opfern der Katastrophe zu begrenzen.

The State Opposition will no doubt be pleased with its upper house inquiry into the Orange Grove fiasco. It has succeeded in compounding the Government's misery as it watches the centre's retailers shut their doors and their employees get the sack. Significantly, the hearings have revealed the Premier, Bob Carr, as less than forthcoming about contacts with the powerful Westfield group which has successfully used the law to shut down Orange Grove. What the inquiry has not done, however, is answer the basic question of why Liverpool Council ever approved Orange Grove's rezoning from bulky goods complex to factory outlet in defiance of its Local Environmental Plan.

Of course, the parliamentary inquiry was always more concerned with goings on in Macquarie Street than at Liverpool Council. It hoped to find some skulduggery behind the State Government's refusal to endorse the rezoning of Orange Grove, even though the Government's stance was in line with rulings by the courts. Had the Carr Government been swayed by Westfield which has a shopping centre nearby? Mr Carr had denied any contact with Westfield or its chief, Frank Lowy, about Orange Grove. However, the inquiry revealed that a Westfield executive, Mark Ryan, had met Mr Carr's chief of staff, Graeme Wedderburn, last April to allege a whiff of corruption about the rezoning of Orange Grove. Mr Wedderburn alerted Mr Carr who told him to alert the Assistant Planning Minister, Diane Beamer. Ms Beamer, too, denied contact with Westfield over Orange Grove - but not for want of trying on Westfield's part. Westfield told the inquiry it had sent a letter to Ms Beamer unsuccessfully seeking a meeting and had tried to phone her (though Ms Beamer says she was not made aware of the call). The inquiry has illuminated the sort of access Westfield thinks it deserves - and actively pursues - but it has not turned up evidence of any favours for Mr Lowy.

With the public dirt-digging at Parliament House due to end on Monday, interest will shift to the Independent Commission Against Corruption which is also investigating the Orange Grove debacle, behind closed doors and without fanfare. The commission can compel evidence, making it a more effective forensic tool than any Upper House inquiry. The community will expect the commission's powers to be used to the full to sweep away the innuendo + to expose the facts about the Orange Grove rezoning.

In May 2002, Sequoia was purchased by Great Britain’s De La Rue plc + Phil Foster’s loyal and trusting boss, Peter Cosgrove, was retained and promoted. De La Rue is considered a blue-chip company. Its fortunes are heavily affected by politics + it has at least one politically active investor. It is the world’s biggest commercial money printer. De La Rue was one of the first British companies to profit from the war in Iraq, earning a quick windfall when it received the assignment to print the new Iraqi bank notes. During the first Bush administration, De La Rue was called in toward the tail end of Sandinista rule in Nicaragua to create new money. 31 De La Rue is also involved in Britain’s national lottery, through its investment in Camelot Group plc. In this capacity, it enraged British citizens when they learned that Camelot had assigned its executives a 40 percent pay hike while reducing the funds allocated to good works. 32 De La Rue would very much like to take Diebold’s position + not just in election systems. Pam Floyd, who had worked for Washington state elections director David Elliott, left to take a position with VoteHere for three years; she recently became Washington’s assistant state elections director + she oversees Washington’s Internet SERVE project. Washington state is now leaving the door open (through legislation proposed by Munro crony and current secretary of state Sam Reed) to arrange for more Internet voting in the state. In 2003, VoteHere decided to go after the innards of other vendors’ touch screens, perhaps hoping to become the Good Housekeeping Seal of Approval for electronic voting machines by claiming that its system verifies the integrity of the vote. This verification system is another way to avoid giving voters the paper ballots they are asking for.

So sei der Einsatz von Soldaten und die Lieferung von Hilfsgütern um bis zu drei Tage verzögert worden.
Zudem hätten verschiedene Einrichtungen nicht mit- sondern gegeneinander gearbeitet, heißt es der Zeitung zufolge in dem Bericht. Bush hätte als einziger die Möglichkeit gehabt, die bürokratischen Widerstände zu brechen. Er habe aber nichts unternommen, um die Reaktion auf die Katastrophe zu beschleunigen. Der Umgang mit dem Hurrikan zeige, dass die Regierung nicht die nötigen Konsequenzen aus den Anschlägen vom 11. September 2001 gezogen habe.
Der 600 Seiten starke Bericht eines Komitees von elf Republikanern unter Thomas Davis schlägt allerdings nur wenige konkrete Änderungen für die Zukunft vor. Der größte Fehler der Regierung habe darin bestanden, die Folgen des Hurrikans nicht vorauszusehen. Experten hatten offenbar schon im Jahr 2004 in einem Katastrophenbereitschaftsplan eine Überschwemmung New Orleans als eines der schlimmsten Szenarien gewertet.

Die Filterleistung der Keramikscheiben dürfte sich durch Verringerung der Porengröße bis sechzig Nanometer noch erheblich steigern lassen. Trösch und seine Kollegen hoffen deshalb, dass diese Technik auch zum Entfernen von großmolekularen, hormonwirksamen Substanzen aus dem Abwasser taugt.
Jürgen Weber, technischer Leiter des Heidelberger Abwasserzweckverbandes, sieht noch ganz andere Möglichkeiten. "Solche Anlagen sind robust und leicht zu handhaben", erklärt er. "Man könnte sie in Container einbauen und schnell in Katastrophengebieten einsetzen." Vom Prinzip her ließe sich die Rotationsscheibenfilter-Technik dort sowohl für die Abwasserreinigung als auch für die Trinkwasser-Aufbereitung verwenden, um so den Ausbruch von Seuchen wie Cholera und Typhus zu verhindern.

Although he and his descendants galloped out of Mongolia to subdue most of the known world, Genghis Khan was buried without a monument or even a headstone, in keeping with Mongol belief that the dead should not be disturbed. Legend has it that the soldiers who carried out the mission were slaughtered to make sure the secret was safe for all time.

Today’s testimony by former FEMA Director Michael Brown raised very serious questions about when the failure of New Orleans’ levees was first reported to Secretary Chertoff and to President Bush. Both men have previously stated that they were not aware of the massive flooding in New Orleans until midday Tuesday. Yet, Mr. Brown testified that he spoke personally with the President, who was vacationing at his ranch, on the weekend before Hurricane Katrina struck + also with top White House staff on Monday afternoon. Likewise, Secretary Chertoff’s Deputy and his Chief of Staff were both e-mailed Monday evening with reports of the levees’ failure.

It is incomprehensible how those top Administration officials failed to notify the President and the Secretary immediately of the catastrophe that was unfolding in New Orleans.”

Any human being, especially the Commander in Chief of the USA military, would have been burning to assess the situation and response procedures more comprehensively and precisely.
No one would conceivably sit there for seven minutes looking nervous - unless they already knew what was going on.
The only half-way rationale I've seen from Bush supporters is that maybe security protocol dictated that the President remain seated and doing what he was doing until they assessed the security situation regarding his immediate movements.
The problem with this is that they already had the school and immediate surroundings well secured as is stricly required. That's their job + they do it well. Everywhere the President goes, the "red phone" goes.  Everywhere the President goes, the "black suitcase goes". Everywhere the President goes, he must be able to be instantly informed of attack + be able to quickly approve response protocols.
To sit for seven minutes + not even try to find out just what the hell was gong on....
There's just no explaining such aberrational behavior away.

Substantial evidence now exists that the Reagan-Bush administration also helped arrange sophisticated military equipment for Iraq through third countries, such as Chile.

In a sworn affidavit in 1995, one of Reagan’s national security aides, Howard Teicher, described CIA contacts with Chile for arranging cluster bombs and other armaments for Iraq.

This covert assistance helped Saddam Hussein build his army into a powerful regional force and may have emboldened him in 1990 when he decided to invade Kuwait, an action that touched off the Persian Gulf War and continues to have geopolitical consequences to this day.

Once we head down that path there would be no end to it, no end to the suffering of innocent people, no end to the bloody ransom all civilized nations must pay.”

U.S. intelligence officials believe that China gleaned sensitive nuclear secrets from exchange programs with U.S. nuclear scientists in the 1980s, contacts accelerated during the Reagan-Bush years as part of a strategy to isolate the Soviet Union.

Many of the U.S.-Chinese scientific exchanges came after Reagan’s White House solicited a favor from China – the secret supplying of surface-to-air missiles to the Nicaraguan contra rebels in 1984. White House aide Oliver North, who let Chinese authorities in on the secret White House contra-supply operation, said China shipped the missiles, in part, to curry favor with the USA.

U.S. intelligence now believes that between 1986 and 1988, the Chinese used those scientific contacts to steal sensitive U.S. nuclear secrets, including how to make a miniaturized W-88 hydrogen bomb. China successfully tested its own small hydrogen bomb in 1992.

The Washington Post reported that Chinese documents turned over by a Chinese "walk-in agent" showed that during the 1980s, Beijing had gathered a large amount of classified information about U.S. ballistic missiles and reentry vehicles. [WP, Oct. 19, 2000]

Die ehemaligen Heimkinder überlegen jetzt, ob sie Wiedergutmachung für Arbeit und Misshandlungen einklagen sollen, etwa nach dem "Gesetz über die Entschädigung für Opfer von Gewalttaten". Dieses Gesetz beinhaltet eine Einstandspflicht des Staates für unschuldige Opfer von vorsätzlichen, rechtswidrigen Gewalttaten. Fürsorgezöglinge wurden in den Erziehungsheimen trotz staatlicher Aufsicht im großen Stil als billige Arbeitskräfte ausgenutzt. Dieses System hatte eine lange Tradition.
In einer Caritas-Festschrift über die katholische Kinder- und Jugendfürsorge hieß es bereits in den dreißiger Jahren: Dem Fürsorgezögling "darf es schon in Fleisch und Blut übergehen, dass die Arbeit in Gottes Auftrag geschieht und nicht bloß klingende irdische Münzen einbringt, sondern auch den ewigen Lohn bedingt. The CANDU reactor system produces 2400 times as much tritium as the American light water reactor. This is a gigantic problem for Ontario Hydro, the operators of Ontario's commercial nuclear power reactors, because tritium is extremely toxic. As little as one billionth of a gram can cause cancer if inhaled, ingested, or absorbed through the skin. One five-hundredth of a gram is fatal to an average person. Thus, since the early days of nuclear power in Ontario, critics have argued that tritium should be removed from the heavy water in the reactors to reduce the exposure of workers and surrounding communities. Ontario Hydro recently began to build a tritium removal facility when it became apparent that there was a very lucrative market for it. It sells for $15 million per kilogram-more than one thousand times the price of gold!

In February, 1934, the British journal, New Scientist, published an article by Tom Wilkie, "Old Age Can Kill the Bomb." It was an ingenious solution to the arms control nightmare of verification; controlling not only the number of weapons, but the strategic materials that fuel them -- mainly plutonium, enriched uranium and tritium. Wilkie focused on tritium, because it turns into non-radioactive helium at a rate of 5.5 per cent per year. A halt of tritium production would rapidly cripple all nuclear arsenals. Thus, attention was rivetted on Ontario Hydro's plan to produce about 57 kilograms of tritium by 2006. A one megaton thermonuclear warhead (equivalent to one million tons of TN") may contain as little as one gram of tritium.

The military are really interested in antimatter, because it's just loaded with energy. They want to use it for bombs and spaceships.

In WW2, the big bombs were called "block-busters" - because they could destroy a whole city block. These bombs carried roughly 20 tonnes of TNT. Then came the atomic bombs. They were about 1,000 times more destructive - equivalent to about 20,000 tonnes of TNT. The next big "improvement" were the H-bombs. They were 1,000 times more powerful than the atom bombs - about 20,00,000 tonnes of TNT. Antimatter bombs will be about 1,000 times more powerful again.

The USA Astronautics Laboratory at Edwards Air Force Base in California (which is a Space Shuttle landing site) has been pouring money into research into how to use antimatter in spacecraft. The magazine Aviation Week and Space Technology was jokingly called Megadeath Weekly because in each issue, it used to discuss new and unusual ways of killing lots of people. Colonel Ross Nunn, the director of the Astronautics Laboratory, said in Megadeath Weekly "The 'giggle factor' about antimatter is over. Antimatter is real + we know how to make it and keep it."

The military already have half a dozen workable designs for anti-matter rockets, thanks to the American NERVA nuclear rocket program of the 1960s. And the technology has already been designed to bring the production cost down to $10 million per gram of antimatter. This works out to $10 per microgram - so the 50 micrograms needed to get us across the deserts would cost about $500. This technology could make grams of antimatter each year.

But cheap space travel is about half a century away. Neue Dokumente nähren Zweifel daran, dass die Bush-Regierung schnell genug auf die drohende "Katrina"-Katastrophe reagiert hat. Zeugen zufolge wusste das Weiße Haus bereits Stunden zuvor, dass der Südstaaten-Metropole New Orleans eine massive Überflutung drohte.

Washington - Angaben des demokratischen Senators Joseph Lieberman zufolge, der dem "Katrina"-Untersuchungsausschuss vorsitzt, sind bislang knapp 30 Gespräche und Mails zwischen den einzelnen Behörden dokumentiert, in denen bereits am Morgen des 29. August von massiven Überschwemmungen in New Orleans die Rede ist. An diesem Tag traf der Hurrikan "Katrina" mit voller Wucht auf die Küste der Südstaaten und ließ verschiedene Deiche um New Orleans herum brechen.
Nach Angaben der "New York Times" sagten Regierungsbeamte dagegen vor dem Ausschuss aus, das Weiße Haus sei erst gegen Mitternacht über die Dammbrüche informiert worden. In früheren Stellungnahmen hatten sowohl Präsident George W. Bush als auch sein Heimatschutzminister Michael Chertoff erklärt, die Dämme seien erst am 30. August gebrochen.
Nach Erkenntnissen der Ermittler schickte jedoch ein örtlicher Sprecher der Katastrophenbehörde Fema bereits um 9.29 Uhr am Abend des 29. Augusts eine dringende E-Mail an das Heimatschutzministerium. Die Nachrichtenagentur Reuters zitiert die Mail des Mitarbeiters mit den Worten, dass die Bedingungen im Hurrikangebiet "weit ernster sind, als die Medienberichte zur Zeit wiedergeben." In der Nachricht warnt der Verfasser ausdrücklich, man stehe vor "erheblichen Überschwemmungen und wesentlich mehr flüchtenden Menschen" als man erwartet habe. Auch einige Feuer seien bereits ausgebrochen.
Schon am Morgen des 29. Augusts hatte Oberst Terry Ebbert, der örtliche Heimatschutzdirektor, in einer Krisenkonferenz mit der Fema, dem Roten Kreuz und anderen Katastropheneinrichtungen von einer sechs Meter hohen Sturmflut gesprochen. Dämme seien gebrochen, vor allem in Osten der Stadt gebe es Überschwemmungen.
Senator Lieberman zeigte sich empört über die langsame Reaktion der Regierung: "Es ist für mich unerklärlich, wie die auf Bundesebene Verantwortlichen am Dienstag, den 30. August, aufwachen konnten, ohne eine Ahnung von der ganz offensichtlich katastrophalen Situation zu haben." Vom Weißen Haus gab es zu dem Bericht bislang keinen Kommentar

Der im Jahr 2000 gebaute Middelgrunden-Windpark steht rund dreieinhalb Kilometer vor dem Kopenhagener Hafen - ironischerweise auf einem Riff, das vorher als Halde für Hafenschlamm und kontaminierten Müll genutzt wurde. Die Ausmaße der 20 in Betonfundamenten verankerten Turbinen sind riesig: Ihre Rotoren haben jeweils einen Durchmesser von 76 Metern, ihre Naben liegen 64 Meter über dem Wasser.
Doch selbst sie können nur einen kleinen Teil des Energiehungers moderner Großstädte stillen: Mit einer Jahresleistung von 89.000 Megawattstunden deckt der Windpark gerade einmal drei Prozent des Energiebedarfs von Kopenhagen mit seinen 1,1 Millionen Einwohnern.
Dabei soll es allerdings nicht bleiben: Der Anteil der Windkraft am dänischen Energiehaushalt steigt rapide. Bis 2040 will Dänemark 40 Prozent seiner Elektrizität aus der Windkraft beziehen. 2001 lag der Wert nach Zahlen der Esa noch bei 13 Prozent.

NEW YORK – A former FBI agent admitted that he gave online stock traders confidential details of federal investigations, including a probe of the Sept. 11 terror attacks.

One of the recipients was San Diego stock speculator Anthony Elgindy. A Justice Department task force had begun the investigation of Elgindy to determine whether anyone might have known of the terrorists' plans and profited by selling vulnerable stocks just before the attacks, Jeffrey Royer said.

Elgindy was not charged in connection with that probe, but an investigation into the ties between Elgindy and Royer led to charges against the two men of racketeering, securities fraud and other crimes. The two are on trial together in federal court in Brooklyn.

Taking the stand Monday in his defense, Royer acknowledged he had revealed the existence of FBI and SEC investigations, executives' criminal records and other sensitive information to Elgindy and associate Derrick Cleveland.

He said the apparent violations were justified because Elgindy and Cleveland were stock-market experts who helped him develop evidence of financial wrongdoing.

Prosecutors say the relationship was criminal. Elgindy was accused of paying Royer for the information and using it to manipulate stock prices and extort companies that were the subjects of investigations.

When pressed by Assistant U.S. Attorney Seth Levine about apparent violations of FBI rules, Royer grew testy, asserting he was an independent-minded agent who had the right to decide what information to reveal.

"It's real easy for you to armchair quarterback when you don't have anything to do with the case," Royer told Levine. "Pursuant to a law-enforcement purpose, I can do anything I want with the files."

Cleveland has pleaded guilty to conspiracy to commit securities fraud and testified against Elgindy and Royer.
